En forma de síntesis reflexiva sobre la vida y la obra de Adolfo Sánchez Vázquez, el trabajo responde in inicialmente a una solicitud de la revista Casa de las Américas. Esta revista-institución había pedido, en justo homenaje a este genuino marxista, un comentario a dos volúmenes que celebraban desde México, con inteligente selección, abierta a la controversia, su 80 aniversario (1995). Se trataba de los libros Adolfo Sánchez Vázquez: los trabajos y los días y En torno a la obra de (...) Adolfo Sánchez Vázquez, editados por Federico Álvarez y Gabriel Vargas Lozano, respectivamente. Publicado originalmente con el título “La empecinada herejía de Adolfo Sánchez Vázquez” en la mencionada revista (núm. 203, La Habana,1996, pp.142-147), el texto fue revisado y actualizado para la presente edición. El título del comentario hace alusión a la permanente actitud de principios de Sánchez Vázquez, quien mantuvo, primero, una actitud crítica (...) ante el marxismo ortodoxo y dogmático que se difundía desde la URSS y el llamado socialismo real y, después, asumió estoicamente la defensa del marxismo cuando aquellos habían desaparecido. This is the introduction to the special issue of the Spanish journal Ágora-Papeles de Filosofía (31/2, 2012) devoted to new Ibero-American contributions to metatheoretical structuralism.

We provide here irrefutable facts that prove the falsehood of the claims published in [1] by Dehmer and Mowshowitz (DM) against our paper published in [2]. We first prove that Dehmer’s definition of node probability [3] is flawed. In addition, we show that it was not Dehmer in [3] who proposed this definition for the first time. We continue by proving how the use of Dehmer’s definition does not reveal all the physico-mathematical richness of the walk entropy of graphs. Finally, (...) we show a few facts about the failure of DM themselves to cite properly the relevant literature in their field. We also show here how the Editors of Complexity have failed to manage the publication of [1] in an appropriate way according to the accepted guidelines given in the Code of Conduct and Best Practice Guidelines for Journal Editors, published by the Committee on Publication Ethics (COPE). Se realiza un análisis comparativo de la idea compartida por Hegel y Martí sobre la centralidad que pueden asumir ciertos pueblos en la Historia y el diferente papel que cada uno le asigna a América en el concierto universal de naciones. Se analiza la posibilidad de que sea por fin el XXI el siglo de Nuestra América, los (...) elementos que confirman el inicio de su realización y los retos y peligros que la consumación de esa posibilidad enfrenta. The article critically develops Nietzsche's presence in Heidegger's second great work, Contributions to Philosophy. Heidegger considers Nietzsche the last metaphysicist. However, being Western Metaphysics' zenith is the greatest thing that can be said of a thinker, since being the one who brings to completion a school of thought makes one, at the same time, the precursor of the ‘other’ begining and thus his concept of God's dead, nihilism and truth really can open the door to a kind of post-metaphysical thought, (...) as Heidegger would say, the thought of the history od being. Therefore, between Nietzsche's "God is dead" and Heidegger's "last God" there exists continuity and parallelism that needs future development. (shrink)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

Urquhart afin de definir une semantique relationnelle valable pour la logique des valeurs infinies de Lukasiewicz (Lw). Evitant les axiomes de contraction et de reduction propres a la logique classique de Dummett, l'A. propose une semantique de type Routley-Meyer pour le systeme d'Urquhart (CI) en tant que celle-la ne fournit que des theories consistantes pour la completude de celui-ci.

In this paper I discuss the scientific respectability of delusion as a psychiatric category. First, I present the essentialist objection to the natural kindhood of psychiatric categories, as well as non-essentialism about natural kinds as a response to that objection. Second, I present a nuanced classification of kinds of kinds. Third, drawing on the claim that the attribution of delusion relies on a folk psychological underpinning, I present the mind-dependence objection to the natural kind status of delusion. Finally, I argue (...) that even if delusion as a generic kind stands little chance of being vindicated as a non-essentialist natural kind, we stand to gain from a natural kind methodology regarding subtypes of delusion for which there is evidence of genuine causal signatures and mechanisms. This paper examines Gandhian philosophy and practice to reinterpret UNESCO's educational vision towards establishing stable and sustainable knowledge societies. The uniqueness of the Gandhian perspective is its ability to withstand the dominant political, philosophical and religious challenges with its contextually rooted, spiritually oriented, socially responsible and human person centred reinterpretations. UNESCO’s educational vision-Learning: The Treasure Within published in 1996 is a catalyst in establishing stable and sustainable knowledge societies. Consistent changes and challenges in knowledge societies necessitates the reinterpretation of this (...) educational vision. The four pillars of learning in this educational vision are analysed together with four aspects of Gandhian philosophy and practice: ‘learning to know’ and Nai Talim, ‘learning to do’ and ashrams, ‘learning to live together’ and constructive programme and ‘learning to be’ and swaraj. The paper discusses this confluence of the UNESCO’s theoretical approach of four pillars of education with Gandhian pragmatic philosophy and practice to offer a contextually rooted and future-oriented outlook for reinterpreting the educational vision for establishing stable and sustainable knowledge societies. We are presently confronted with an impressive growth of the religious phenomenon. This can be observed not only related to both the outbreak of new religions and the increasing attendance to worship services, but also for the presence of the religious language in the political discourse. We can see nowadays a political use of religion and a religious use of politics. When we approach the religions in a large scale perspective is possible to verify that in all of them both (...) aspects live together, and they are contradictory and excludent only in appearance. This evidence brings some particular questions: there would be more political and bellicose religions than others? Or maybe the contentious nature of religions rises when they become ideologies, in the same way ideologies impose themselves politically when they act like religion? We will let ourselves be guided by this hypothesis in order to explore the ambiguous relation between politics and religion. It was precisely after the death of the ideologies that religions of any creed reappeared strongly in the scenario. We will take as references to this theoretical task two thinkers in particular: Marsilius of Padua and Machiavelli. They both will guide us to think respectively the religious use of politics and the political use of religion. -/- Estamos confrontados na atualidade com um vertiginoso crescimento do fenômeno religioso. Isso pode ser observado não apenas pelo surgimento de novas religiões e o aumento da frequência aos cultos, mas também pela presença da linguagem religiosa no discurso político de tal modo que podemos falar num uso político da religião e um uso religioso da política. Quando abordamos as religiões na longa duração, percebemos que em todas elas coabitam estes dois aspectos, contraditórios e excludentes apenas na aparência. Esta constatação leva ao questionamento: existiriam religiões mais políticas, ou mais conquistadoras, do que outras? Ou então, talvez, a natureza belicosa das religiões emergiria a partir do momento em que elas se erigem em ideologias, da mesma forma como as ideologias se impõem politicamente quando agem à maneira de religiões? Neste trabalho nos orientaremos por esta hipótese para explorar a relação ambígua entre política e religião, pois foi precisamente após a morte das ideologias que as religiões, independente do credo, retornaram com toda a força. Para tanto, tomaremos como referência teórica dois pensadores, Marsílio de Pádua e Nicolau Maquiavel, para pensar, respectivamente, o uso religioso da política e o uso político da religião. (shrink)

: En el trabajo se busca constatar y analizar los fundamentos de la simbiosis armoniosa que se da entre lo poético y lo filosófico en el pensamiento de José Martí. Tal imbricación la encontramos no sólo en él. Ha llegado a ser bastante frecuente en un contexto como el latinoamericano. Pero, tal vez sea en Martí en quien esa fusión se acrisola de manera más brillante. Nunca se preocupó demasiado por el contenido filosófico de su poesía ni por la (...) forma poética con que vertió sus pensamientos más profundos y de mayor alcance. O, dicho de manera más exacta, sí se preocupó, y mucho, porque lo uno y lo otro nunca estuviera ausente. Y por esa misma razón fue siempre más que poeta y más que filósofo, fue escritor y pensador, o como prefirieron llamarlo sus contemporáneos, fue maestro, en cualquier caso, universal, con todas las posibles acepciones que a este último término pueda otorgársele, excepto de aquella que asume la universalidad como el despego de lo propio y particular. Eso sí no lo encontraremos en Martí. En ningún momento olvidó, no importa el lugar donde se encontrara, que escribía y pensaba desde y para su colonizada Cuba y desde y para su también sufrida América. (shrink)

Clinical delusions are widely characterized as being pathological beliefs in both the clinical literature and in common sense. Recently, a philosophical debate has emerged between defenders of the commonsense position (doxasticists) and their opponents, who have the burden of pointing toward alternative characterizations (anti-doxasticists). In this chapter, I argue that both doxasticism and anti- doxasticism fail to characterize the functional role of delusions while at the same time being unable to play a role in the explanation of these phenomena. I (...) also argue that though a more nuanced view of belief in which mental states are more or less belief-like instills a healthy skepticism towards the precision of folk-psychological concepts, such a stance fails to be of use in building a theory of delusion that will be able to bridge different levels of explanation, such as the phenomenology and neurobiology of delusion. Thus, I advocate moving past the question ‘Are delusions beliefs?’ and their description as propositional attitudes toward the description of the processes that generate delusion, with a view toward explaining, rather than explaining away, the personal-level aspects of the phenomenon that have been made inscrutable by investing in doxastic terminology. El artículo busca acercarse a la comprensión de los rasgos particulares de los valores estéticos, fundamentalmente en las obras de arte. Para ello parte de la premisa de que el valor estético no es en sí mismo un atributo del objeto artístico, ni el resultado exclusivo de la plasmación en él de cierto ideal estético. Para que un objeto sea portador de valor estético ha de funcionar precisamente como tal, lo cual presupone la presencia y participación de otros sujetos que (...) así lo perciban y un contexto social que favorezca esa percepción. Asociar el valor estético a la función social del objeto, particularmente a su capacidad de enriquecer espiritualmente a su público receptor, permite comprenderlo dinámicamente y resolver muchas dificultades generadas por diferentes concepciones unilaterales del valor artístico. La misma fue realizada por José Ramón Fabelo Corzo y Rodrigo Walls Calatayud, en representación del equipo de Colección La Fuente, y tuvo lugar en noviembre de 2020, durante la época de confinamiento mundial debido a la pandemia por la COVID-19. Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

Incluido a modo de prólogo en el libro Epistemología crítica de la violencia del capital. Verdad y violencia epistémica, el trabajo “Verdad y violencia epistémica. Desafíos al conocimiento humanista sobre lo universal” busca analizar críticamente esa forma particular de violencia que, utilizando herramientas epistemológicas, se basa en el control monopólico de la verdad y en el secuestro de la universalidad humana por parte de aquellos que encarnan los intereses asociados a la lógica del capital y que, precisamente gracias a ese (...) control y a ese secuestro, hacen pasar por verdadera y universal su propia visión del mundo. Al mismo tiempo, se devela la complicidad que con tal posición posee en los hechos, sea o no consciente de ello, aquella postura teórica que, para supuestamente enfrentar tal usurpación de la verdad y la universalidad, asume como salida la negación en abstracto de la existencia misma de la una y la otra. En contraste crítico con esta postura, el trabajo se propone mostrar las condiciones de posibilidad real y concreta del conocimiento verdadero sobre lo universal. (shrink)

Given the oncoming demographic changes—which are primarily driven by the growth in the Latinx community—the United States is predicted to become a minority-majority country by around 2050. This seems to suggest that electoral strategies that employ “dog-whistle” politics are destined for the dust-bin of history. Following the work of critical race theorists, such as Ian Haney-Lopez and Derrick Bell, I want to suggest that pronouncing the inevitable demise of dog-whistle politics is premature. This is because there are reasons to suspect (...) that certain segments of the Latinx community—much like the Southern and Eastern Europeans in the early part of 20th Century—might be co-opted into American whiteness. In the graphical representation of ontologies, it is customary to use graph theory as the representational background. We claim here that the standard graph-based approach has a number of limitations. We focus here on a problem in the graph-based representation of ontologies in complex domains such as biomedical, engineering and manufacturing: lack of mereotopological representation. Based on such limitation, we proposed a diagrammatic way to represent an entity’s structure and various forms of mereotopological relationships between the entities.

The question of how psychiatric classifications are made up and to what they refer has attracted the attention of philosophers in recent years. In this paper, I review the claims of authors who discuss psychiatric classification in terms referring both to the philosophical tradition of natural kinds and to the sociological tradition of social constructionism — especially those of Ian Hacking and his critics. I examine both the ontological and the social aspects of what it means for something to be (...) a mental disorder, and how the ontological status of these disorders hinges on social causation. Finally, I conclude by suggesting a way in which the biological and the social may be reconciled in an integrative model of variation in psychiatric disorder. (shrink)

Se reflexiona sobre los orígenes de la identidad mestiza latinoamericana y sobre el papel del mestizaje cultural en la búsqueda de caminos propios que den respuesta a los valores nacidos de la peculiar historia de Nuestra América. Se analiza también, desde el punto de vista axiológico, el proceso de independencia latinoamericano (1810-1825), sus alcances y límites identitarios. El cambio radical que implicó la Independencia exigía también un cambio de cultura. Pero la cultura autóctona no estaba preparada para suplir a la (...) que hasta entonces había sido dominante. Había que comenzar por pensar la cultura propia, por indagar cuál era ella y qué sistema social estaría en correspondencia con sus valores. Si cae en descrédito el sistema de valores que durante tres centurias había sido impuesto, si todavía no hay plena conciencia del sistema propio, si además a ambos se tildan de inferiores, por hispánico uno y por mestizo el otro, entonces es lógico que se busque en otro lugar el sistema de valores que habría de instituirse oficialmente en las nacientes repúblicas americanas. La lógica de la época empujaba al latinoamericano a depositar sus ojos en la otra Europa, en la Europa avanzada, de la cual los Estados Unidos de Norteamérica eran vistos ya como una mera extensión extracontinental. Allí parecía estar el porvenir, el futuro de progreso, el mejor sistema de valores posible. ¿Lo estaba en realidad? (shrink)

Se trata, como su nombre lo indica, de 14 tesis elaboradas en diálogo con los dos más importantes libros sobre estética de Adolfo Sánchez Vázquez. El propósito es ir acercando respuestas a la pregunta sobre la especificidad de los valores estéticos. El texto, que fue publicado originalmente bajo el título “14 tesis sobre los valores estéticos”, en 1999 (Cuadernos Valeológicos, Serie: Valores, 1999, núm. 7, pp.1-42) ha sido revisado y actualizado para la presente edición.

Nos proponemos en esta exposición indagar en los fundamentos últimos u originarios de lo ético como fenómeno humano presente en cualquier ámbito social, en cada etapa de la historia, en toda cultura. Nos interesa acercar una respuesta a preguntas cruciales: ¿por qué necesitamos una ética, una noción del bien, un concepto de lo justo, de lo bueno, de lo correcto, desde el que podamos juzgar los fenómenos, procesos y acontecimientos que se relacionan con nuestra vida? ¿Cómo llega lo ético a (...) convertirse en ético? En resumen, ¿cuáles son los fundamentos de la ética? La tesis central que defendemos y que nos interesa aquí mostrar es que las raíces históricas últimas de lo ético están en la vida humana misma, que lo ético responde a una necesidad humana vital y que es precisamente en la vida donde hemos de encontrar el buscado criterio de última instancia sobre lo que lo ético es. The status of art in Plato's philosophy has always been a difficult problem. As a matter of fact, he even threw the poets out from his ideal state, a passage that has led some interpreters to assess that Plato did not develop a proper philosophy of art. Nevertheless, R. G. Collingwood, wrote an article titled “Plato's Philosophy of Art”. How can it be? What could lead one of the most important aesthetic scholars of the first half of the twentieth century (...) to make this thesis about Plato? To understand Collingwood's position at that time, I will review it in a new light: his own philosophy of art at that moment as it was propounded in Outlines of a Philosophy of Art, a work he published that same year. I will also examine how Collingwood's position changed when he returned to the same subject in 1938, on the publication of The Principles of Art. Finally, I will end this article defending the correctness of Collingwood's earlier interpretation of Plato's position on art. (shrink)

The social trust argument asserts that a political community cannot survive without social trust, and that social trust cannot be achieved or maintained without a political community having discretionary control over immigration. Various objections have already been raised against this argument, but because those objections all assume various liberal commitments they leave the heart of the social trust argument untouched. This chapter argues that by looking at the socio-historical circumstances of Latino/as in the United States, an inherent weakness of the (...) social trust argument gets exposed. Giving a political community discretionary control over immigration not only fails to deliver on the promise of social trust, but it actually seems to promote its opposite, social mistrust. This suggests that a far better way of promoting the goal of social trust, and at the same time abating social mistrust, is to actually circumvent a political community’s ability to control immigration by giving priority both to socio-historical circumstances and immigrant rights (at least in a minimalist sense) in determining immigration policy. Reflection on the nature and value of fiction has often paid attention to the possibility of acquiring knowledge through engaging with fictional works. The alleged imaginative character of fiction appreciation and the sort of emotional responses that fiction is able to prompt in the viewer have been frequently invoked in order to explain the peculiar cognitive value that fictions may possess. In this paper, I would like to question whether fiction as such possesses a specific kind of value. Although I (...) agree that fictional works can convey certain kinds of knowledge, I think that the cognitive virtues that we attribute to fictional works do not have much to do with their fictional character as such. Rather, these values are grounded upon the various properties that the different representational artifacts that can serve to produce fictional works possess. Thus while I think fictional works can deliver various sorts of cognitive value, this value is not intrinsically connected with the fictional nature of these works. (shrink)

The epistemic status of Natural Selection has intrigued to biologists and philosophers since the very beginning of the theory to our present times. One prominent contemporary example is Elliott Sober, who claims that Natural Selection, and some other theories in biology, and maybe in economics, are peculiar in including explanatory models/conditionals that are a priori in a sense in which explanatory models/conditionals in Classical Mechanics and most other standard theories are not. In this paper, by analyzing what we take to (...) be the four possible interpretations of Sober’s claim, we argue that, terminological preferences aside, the possible senses in which explanatory models in Natural Selection can qualify, or include elements that can qualify, as a priori, also apply to Classical Mechanics and other standard, highly unified theories. The fully understanding of the Machiavellian concept of the State depends on the determination of the idea of political equality. Political equality must be conceived, in its turn, as domination equality and absence of privilege/precedence; in other words, absence of subordination. Taking into account a definition such as that, the Machiavellian model of the State could only be the Republic. So, this paper argues G. Pancera`s view, proposed in his book “Maquiavel entre Repúblicas”, that such model of the State was (...) more explicitly formulated in Machiavelli`s Discursus. This interpretation will be questioned, pointing out the existence of textual elements in the Discursus which allow us to think that a Principate or a Monarchy could also be among Machiavelli’s purpose to the reform of the Florence State examined in the Discursus. -/- Para captar a concepção maquiaveliana de Estado é necessário determinar a ideia de igualdade política. Esta deve ser entendida como igualdade de comando e ausência de privilégio/precedência, ou seja, ausência de subordinação. Considerando esta definição, o modelo de Estado maquiaveliano só pode ser a república. O artigo discute a partir da obra de G. Pancera “Maquiavel entre repúblicas” a questão, levantada por Pancera, de que seria no Discursus de Maquiavel que semelhante modelo de Estado estaria formulado de modo mais explícito. Problematizaremos esta interpretação apontando para a existência de elementos textuais da obra citada que autorizam pensar que igualmente um principado ou monarquia poderiam estar na intenção de Maquiavel na reforma do Estado de Florença examinada no Discursus. Isto está de acordo com uma concepção do lugar do ser humano na natureza como um lugar de destaque e superioridade em relação às outras formas de vida. Por outro lado, a gradual substituição desta postura leva a uma aproximação entre os seres vivos e a uma destituição do lugar de domínio que se julgava ser ao homem devido. (...) Tudo isso, naturalmente, vai resultar em uma crítica ao conceito tradicional de razão, como a faculdade exclusivamente humana de encontrar a verdade. Ao que parece, a fi losofi a não está em condições de, sozinha, julgar até que ponto a origem comum com os outros seres vivos é relevante para a teoria do conhecimento. Entretanto, é do maior interesse descobrir até que ponto se pode estender esta analogia entre o ser humano e os animais. Diante das similaridades reveladas pelas ciências, procurar este elemento de distinção no meio ambiente cultural parece bem mais viável do que procurar entre as capacidades cognitivas do sujeito. Necessity can be ascribed not only to propositions, but also to feelings. In the Critique of Judgment (KdU), Immanuel Kant argues that a feeling of beauty is the necessary satisfaction instantiated by the ‘free play’ of the cognitive faculties, which provides the grounds for a judgment of taste (KdU 5:196, 217-19). In contradistinction to the theoretical necessity of the Critique of Pure Reason and the moral necessity of the Critique of Practical Reason, the necessity assigned to a judgment of taste (...) is exemplary necessity (KdU 5:237). Necessity can also be assigned by employing the de re/de dicto distinction, namely, by ascribing entailments of what must necessarily hold to either a thing (de re) or to a proposition (de dicto). Although Kant does not use the distinction in any of the three Critiques, this omission has not prevented Kant scholars from applying the distinction in their analyses of the first two Critiques. In this paper, I examine the role that modality plays in Kant’s third Critique and I attempt to bring the de re/de dicto distinction to bear on Kant’s famous aesthetic theory. Ultimately, I perform a retrospective classification of the modality of taste by arguing that because a judgment of taste is not a statement about an objective fact, a judgment of ‘x is beautiful’ can only be read as de dicto necessary. In this paper, we take our cue from Kevin Schilbrack’s admonishment that the philosophy of religion needs to take religious practices seriously as an object of investigation. We do so by offering Afro-Brazilian traditions as an example of the methodological poverty of current philosophical engagement with religions that are not text-based, belief-focused, and institutionalized. Anthropologists have studied these primarily orally transmitted traditions for nearly a century. Still, they involve practices, such as offering and sacrifice as well as spirit possession and (...) mediumship, that have yet to receive attention from philosophers. We argue that this is not an accident: philosophers have had a highly restricted diet of examples, have not looked at ethnography as source material, and thus still need to put together a methodology to tackle such practices. After elucidating Schilbrack’s suggestions to adopt an embodiment paradigm and apply conceptual metaphor theory and the extended mind thesis to consider religious practices as thoughtful, we offer criticism of the specifics of his threefold solution. First, it assumes language is linear; second, it takes a problematic view of the body; and third, it abides by a misleading view of the “levels” of cognition. We conclude that the philosophy of religion should adopt enactivism to understand religious practices as cognitive enterprises. (shrink)

In this paper, we discuss an abductive argument for the existence of God from the experience of awe at natural beauty. If God's creative work is a viable explanation for why we experience awe at natural beauty, and there is no satisfactory naturalistic explanation for the origins of such experiences, then we have defeasible evidence that God exists. To evaluate the argument's tenability, we assess the merits of the two main theocentric frameworks that can be marshaled to answer the question (...) of why human beings experience awe at natural beauty: (1) taking the experience of natural beauty as resulting from God's design intentions and (2) conceiving experiences of natural beauty as religious experiences in themselves. We argue that the presence of phenomenological content the fine-grainedness of which exceeds our descriptive and conceptual capacities is better accounted for by the latter hypothesis: experiencing natural beauty amounts to experiencing divine attributes. We conclude that the argument's theological premise is tenable and, having previously argued for the empirical premise (Porcher & De Luca-Noronha, 2021), we conclude that awe at natural beauty is best explained by the existence of God. Since at least the second half of the 19th century, the U.S. federal government has enjoyed “plenary power” over its immigration policy. Plenary power allows the federal government to regulate immigration free of judicial review and thereby, with regard to immigration cases, minimize the Constitutional protections afforded to non-citizens. The justification for granting the U.S federal government such broad powers comes from a certain understanding of sovereignty; one where limiting sovereign authority in cases like immigration could potentially undermine its legitimacy (...) and thereby lead to something like a Hobbesian “state of nature.” One of the potential downsides of allowing the federal government to have such broad powers, however, is the potential to place non-citizens in a situation analogous to what Giorgio Agamben has called the “state of exception.” This situation appears to leave us with the following dichotomy: without something like the plenary power doctrine a political community will end up with a state of nature, but with something like the plenary power doctrine they end up with a state of exception. This essay offers a two-part response to this dilemma. First, it argues that the plenary power doctrine goes against the spirit of the U.S. Constitution, specifically the Fourteenth Amendment. Non-citizens, even undocumented immigrants, are entitled to more Constitutional protections than they currently enjoy. Second, since extending these protections is more consistent with the spirit of the Constitution, I argue that curtailing the federal government’s power over matters of immigration does not undermine its sovereignty, but promotes it. In short, with regard to immigration, it is a false but seductive dichotomy that constitutional democracies must choose between a state of nature and a state of exception. (shrink)

Since the resurgence of infinitism in contemporary epistemology, Peter Klein has been consistent in providing arguments against the three other possible solutions (i.e., foundationalism, coherentism, skepticism) to the Regress Problem, which in turn is a key aspect of the justification condition for the traditional account of knowledge as justified true belief. Klein’s successful effort in reviving the often-dismissed solution and further advancing it as the sole solution to the Regress Problem cannot be ignored as he finds it necessary to not (...) only raise problems for the viability of the three contenders but, more so, definitively invalidate them as equally possible solutions. This paper responds to Klein’s objection to foundationalism, the crucial reasons for which he offers in several of his works concerning infinitism and the Regress Problem: i) that foundationalism inevitably leads either to arbitrariness or to the continuation of the regress of reasons; ii) that a proposition continuously enhanced by reasons has more epistemic warrant than a proposition supported by a chain of reasons which ends at basic beliefs, and; iii) that basic beliefs are not tantamount to fully justified beliefs. For each, certain problems can be raised by employing foundationalist arguments in order to arrive at the conclusion that in spite of his astute reasoning, Klein’s objection is insufficient to rule out foundationalism as a possible solution to the Regress Problem. Alasdair MacIntyre’s work in ethics follows in the footsteps of twentieth century efforts to put the ideals of Enlightenment and modernity on trial, and his book After Virtue diagnoses a wide-spread malaise in contemporary moral discourse. As a corrective to this condition, MacIntyre offers a remedy along Aristotelian-Thomistic lines. He specifically conceives of a recovery of these lines that would allow for a common ground in moral debates which would reveal the normative and teleological character of the human good. However, (...) within these pages, I argue that MacIntyre underestimates how his moral corrective is actually a re-inscription of the Enlightenment project, and thus equally doomed to failure. I do this by sketching out three different lines. First, I present MacIntyre’s appraisal of modern moral discourse, which has long since abandoned a reliance on Aristotelian principles of ethics. Second, I outline an informative disjunction MacIntyre sets up between having to choose between a Nietzschean or an Aristotelian model of ethical action. Last, I argue that MacIntyre’s own choice, simultaneously based on, but also diverging from, Aristotle fails because his revamped account of the virtue formation so necessary for modern human flourishing leaves open a space for its development according to contingent histories and traditions, which implies an attenuated account of the virtue ethics he seeks to recover, and vindicates, rather than condemns, the Enlightenment’s attempt to liberate moral theories from its strict teleological forbears. Immanuel Kant’s work on the sublimity of aesthetic experience lends itself to puzzlement, if not misclassification. Complicating matters, Kant distinguishes between two kinds of sublimity: respectively, the “mathematical” and “dynamical” sublime. More mystifying is that the sublime is ineffable, beyond the ken of human comprehension. These perplexities notwithstanding, Kant argues that sublime sentiment produces a feeling of supersensible comfort. Commentators identify this comfort emanating most strongly from the dynamical sublime. However, in this paper I draw from the unity of reason (...) thesis to offer a plausible account of how the mathematical sublime is equally capable of providing the same feeling of supersensible comfort. G.W.F. Hegel argues that a philosophy of history should engender comprehension of evil in the world. And yet some commentators have charged his philosophy with transcending mere explication by justifying the existence of these evils. In defense of his words, Hegel famously characterizes evil as a modal mismatch; namely, as the incompatibility between what is given and what ought to be the case. Unfortunately, some readers of Hegel’s grand narrative either continue to struggle with or overlook this fine distinction. Against (...) such readings, I organize my paper into three sections that speak directly to these concerns. In §1, against the concern that Hegel’s view of the “actual world” justifies suffering, it is shown that his philosophy does not endorse the merely extant world, which is a whole world apart from the actual world. In §2, I articulate the premises of Hegel’s Doppelsatz to argue that the famous slogan is not, as some commentators take it, an endorsement of “things as they are.” And in §3, I expose a category error that mistakes an epistemological claim made by Hegel about contingency as a metaphysical assertion in support of evil. Ultimately, I argue that Hegel views evil as neither actual nor necessary nor justified. (shrink)
